PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE WEB SITE. YOUR USE OF THE WEB SITE CONFIRMS YOUR UNCONDITIONAL ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS.
Age Requirement. You must be 21 years of age or older to purchase any alcoholic beverages from crushandbrew.com. When purchasing alcoholic beverages, you will be asked to enter your date of birth. By doing so, you attest that you are 21 years of age or older and that you are not purchasing alcoholic beverages for anyone under the age of 21. We reserve the right to require proof of age prior to shipping or upon the delivery of any alcoholic beverage. Valid government-issued photo identification is required for age verification.
Signature at Delivery. The shipment or delivery of alcoholic beverages requires that someone 21 years of age or older be present to sign for the items. The individual signing for the shipment must present valid, government-issued photo identification for age verification. In the event that no one is available to sign for the items, the items will be held and delivery attempted again. In the event a package is delayed or returned after multiple delivery attempts because no one 21 years of age or older was able to sign for the package, we reserve the right to refund only the value of salable items, at our discretion. Shipping or delivery fees are not eligible for refund.
Ineligible states. Unfortunately, we cannot ship alcoholic beverages on your behalf to certain states. You accept responsibility for compliance with your local and state laws regarding the purchase and transport of alcoholic beverages.
Compliance with state and local laws. By purchasing alcoholic beverages from crushandbrew.com, you accept responsibility for compliance with your local and state laws regarding the purchase and transport of alcoholic beverages.
If any portion of this site does not comply with any local or state laws, rules or regulations governing solicitation, advertising, shipping and/or transacting business in such jurisdiction, then any offers shall be void to the extent prohibited by law.
Taxes. By purchasing alcoholic beverages from crushandbrew.com, you accept responsibility for compliance with any local or state taxes relating to the purchase of alcoholic beverages.
Ownership and Transport of Product of Alcoholic Beverages. Crush & Brew gourmet market is happy to offer shipping services for any of the beverages you purchase on our site. Ownership of any product is transferred to you at the time you place your order. Shipping or transportation services are offered as a service to you and are offered on your behalf, with the common carrier acting as your agent. As the buyer, you accept sole responsibility for the shipment of alcoholic beverage products. By placing an order and utilizing the shipping services offered, you accept responsibility for all compliance with your local and state laws regarding the purchase, transport or delivery of alcoholic beverages. Alcoholic beverages are sold in Indiana. We make no representation as to your legal right to purchase or ship wines or alcoholic beverages into or within any state.
You also attest to being at least 21 years of age, that the beverages are not being purchased for anyone under the age of 21, to having any required permit, license or permission, to having paid any fees or taxes as required by your state or local laws and that you are legally authorized to take ownership of the alcoholic beverage in the quantities ordered.
Address Accuracy. Getting your gift or order to its destination is very important to us. Together with our preferred shipper UPS, we endeavor to address any shipping problems to prevent any delays. However, please be sure to verify the accuracy of the address and phone numbers you provide us, as we cannot guarantee timely delivery in the event that any of the information you provide to us is incorrect. In the event a package is returned after multiple delivery attempts or is significantly delayed as the result of you having provided inaccurate address information, we reserve the right to refund only the value of salable items. Shipping fees are not eligible for refund. We reserve the right to make corrections to the delivery address in the event of inaccuracy or error. Fees incurred as a result of customer error are the responsibility of the customer.
Shipping Delivery Dates and Cost. Crush & Brew will do everything in its power and will make every effort to meet requested delivery dates. However, Crush & Brew has no influence over restrictions, routes, schedules, and circumstance of delivery companies, and thus cannot guarantee that the actual delivery date will be the same as requested. Additionally, shipping costs calculated at the time of purchase reflect Crush & Brew’s good faith estimate of delivery company’s shipping costs. Shipping costs are subject to change by delivery company so actual shipping cost will be charged to you at the time your package ships.
Tracking Packages. You will receive a confirmation e-mail with an order number. You can use this order number to track your order. You will also receive a confirmation e-mail when any of your packages ship. You will also receive a confirmation e-mail letting you know the package has been delivered.
Insurance. Our passion is in the products that we offer, and we want to make sure they arrive at their destination in perfect condition. However, accidents during transit can happen. You can take comfort in knowing that all of your purchases are shipped insured for their full value. Returning something? The package is insured upon return as well! Addresses not served/limited service. Please accept our apologies, as we do not currently ship to PO, APO or FPO boxes, to U.S. territories or international addresses. Next-day and/or 2-day delivery may not be available to all zip codes.
Perishable items. We are excited to share with you our selection of artisan cheeses and gourmet chocolates. These perishable and highly temperature sensitive foods require special handling during shipping. We pack perishable items in insulated containers with chill packs to maintain proper temperature. Please note that when shipping perishable items, we insist on only next day-air or a delivery method that guarantees next-day delivery to ensure your order arrives in perfect condition. Because of this precaution, certain delivery days may not be available.
Temperature extremes. We want to make sure the items you order arrive in the best condition possible. Certain items, though not necessarily perishable, may suffer if exposed to extreme temperatures for long durations during transit with our shipper (areas such as a hot warehouse over the weekend). We will alert you when such potential exists. While we package your purchase to minimize exposure to such extremes, to prevent deterioration we suggest a specific method of delivery. Unfortunately, we cannot guarantee product quality if you do not select our suggested method of delivery.
Accuracy of Information. Our team is dedicated to making sure your online shopping experience is as good as if you had visited us in our store. While we strive to make sure all of the information on our website (available inventory, prices, descriptions and other information) is accurate, we make no warranty as to the accuracy of information and reserve the right to correct information, even if this involves changing or canceling an existing order. In addition, we reserve the right to not honor a price on our site in the event the price is in error. We will do our best to contact you as soon as possible in the event an error or problem is discovered.
Account and Purchasing Information. By using our site, you accept responsibility for protecting and maintaining your username and password and for restricting access to your computer if you have saved your username and password. By creating a username and password, you agree to be responsible for any and all activities that occur under your username and password. Crushandbrew.com values the security of your information, however, we will not be responsible for any loss or damage resulting from your failure to protect your username and password. You are responsible for notifying us immediately if you become aware of the theft, loss or unauthorized use of your username or password.

We make no warranty as to the availability, features or content of this site. We regret we cannot accept any responsibility for any loss by you or to any third party arising from lack of access or modification of service or content.

COLLECTIBLE WINE POLICY
Like you, we appreciate the subtle differences that make truly remarkable wines worth collecting. We go to great effort to offer the best products we can find.
When we purchase unique products (including those from other collectors), we carefully evaluate each bottle to ensure it meets our quality standards.
Though all wines may vary from bottle to bottle, certain older bottles may have been subjected to any number of conditions, which could affect their character. In addition, older bottles can also show cork deterioration, which may impact flavor.
As a result, the sale of certain “collectible” wines (those with a price of $150 or more per bottle) are subject to the following terms and conditions.
No returns, exchanges or refunds (Except in the event we have shipped the incorrect item or when breakage/fracture during shipping has occurred. Such issues must be reported within 7 days of delivery).
Product quality, flavor or consistency cannot be guaranteed or warranted.
